2. Scope

These terms and conditions of participation apply to all sweepstakes and promotions conducted by LT Toys GmbH through its online channels (e.g. Instagram, Facebook or website).

3. Participation

Participation takes place by fulfilling the conditions of participation specified in the respective sweepstake or promotion (e.g. commenting on a post, liking or other interactions).

Participation is free of charge and not tied to the purchase of goods or services.

4. Eligibility

Eligible participants are natural persons aged 18 years or older with a permanent residence in Germany, unless otherwise specified in the respective sweepstake or promotion.

Employees of the organizer and their relatives are excluded from participation.

5. Participation Restrictions

Only one entry per person is permitted, unless otherwise specified in the respective sweepstake or promotion. Multiple entries, the use of multiple profiles, and participation via automated processes (e.g., bots or sweepstake services) are not permitted.

6. Prizes

The type and scope of the prizes are specifically described in the respective sweepstake or promotion.

Cash payment, exchange, or transfer of prizes is excluded, unless expressly stated otherwise.

7. Participation Period

The participation period will be stated separately in the respective sweepstake or promotion.

8. Winner Determination

Winners will be determined by random draw or according to the criteria defined in the sweepstake or promotion after the participation period has ended.

9. Prize Notification and Acceptance

Winners will be notified via the respective channel of the sweepstake or promotion (e.g., direct message on Instagram or Facebook).

If winners do not respond within 5 days of notification, the organizer reserves the right to determine a new winner. Deviating deadlines in special terms and conditions remain unaffected.

Publication of a winner's name, profile name, or photo and video recordings will only take place with their prior, separate consent. Consent is voluntary, not a prerequisite for participation or prize delivery, and can be revoked at any time with effect for the future.

10. Shipping / Prize Handling

Personal data (e.g., name, address) will be collected for the purpose of handling the prize.

Prizes will only be shipped to addresses within Germany, unless otherwise stated.

For shipping and transport damages, legal regulations apply. In case of a lost or damaged shipment, please notify the organizer in a timely manner.

11. Data Protection

The processing of personal data is carried out exclusively for the execution and handling of the respective sweepstake or promotion (Art. 6 para. 1 lit. b GDPR), insofar as this is necessary for the participation relationship.

Insofar as consent is obtained for the publication of names, profile names or image or video recordings, processing is based on Art. 6 para. 1 lit. a GDPR.

Data will only be passed on to third parties to the extent necessary for the execution of the sweepstake or promotion (e.g. shipping service providers).

After the complete processing of the sweepstake or promotion, the data will be deleted, unless statutory retention periods exist.

12. Disclaimer for Platforms

This sweepstake is not affiliated with Instagram, Facebook, or other platforms and is in no way sponsored, endorsed, or organized by them.

The sole contact person and responsible party is the organizer.

13. Exclusion from the Sweepstake

The organizer reserves the right to exclude participants from the sweepstake or promotion if they violate these terms and conditions, provide false information, or attempt manipulation.

14. Premature Termination / Changes

The organizer may change, adapt or prematurely terminate a sweepstake or promotion for good cause, if a proper execution can no longer be guaranteed for technical, legal or factual reasons and the reason is not attributable to the organizer.

Changes will only be made if they are necessary and the legitimate interests of the participants are appropriately considered.

15. Liability

The organizer is liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body or health.

In cases of simple negligence, the organizer is only liable for the breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable, typical damages.

Liability under mandatory statutory provisions, in particular under the Product Liability Act, remains unaffected.

16. Legal Recourse

Legal recourse is not excluded.

17. Applicable Law

The law of the Federal Republic of Germany applies. Mandatory consumer protection regulations of the state in which a participant has their habitual residence remain unaffected.

18. Severability Clause

Should individual provisions of these terms and conditions of participation be or become wholly or partially invalid, the statutory provisions shall take their place. The validity of the remaining provisions remains unaffected thereby.

19. Special Terms and Conditions of Participation for Individual Promotions

For individual sweepstakes or promotions, supplementary or deviating terms and conditions of participation may apply. These will be published in the respective post, on the promotion page, or in a document linked there. In case of contradictions, the special terms and conditions of participation shall take precedence over these general terms and conditions.

20. Special Terms and Conditions of Participation: "Bocholt September Babies - Wooden Tricycle Raffle 2026"

20.1 Type of Promotion

The "Bocholt September Babies - Wooden Tricycle Raffle 2026" is a free sweepstake with a lottery procedure. Out of all complete and timely applications received, ten families will be drawn randomly in accordance with these special conditions.

20.2 Eligibility

Eligible participants are adult, legal guardians of a child born in Bocholt, North Rhine-Westphalia, between September 1, 2026, and September 30, 2026, inclusive. The later delivery address must be in North Rhine-Westphalia.

The promotion applies to all first names. The names "Lea" and "Lean" are used exclusively as example personalizations in communication and on photos.

Only one registration per eligible child will be entered into the draw. Multiple registrations for the same child do not constitute an additional chance to win.

20.3 Participation Period and Registration

Registration is possible from September 1, 2026, to October 31, 2026, 11:59 PM, via email to info@schmatzepuffer.de.

For a complete registration, the first and last name of the participating legal guardian, confirmation of legal age and guardianship, the child's first name for personalization, date of birth, place of birth Bocholt, and the postal code of the future delivery address in North Rhine-Westphalia are required. The sender's email address will be used for communication regarding the raffle.

Information regarding time of birth, birth weight, and height at birth is voluntary. It does not affect participation, the draw, or the verification, and serves solely for personal feedback from Schmatzepuffer. It will not be published without prior, separate consent.

Participation is free of charge, not tied to a purchase, and does not constitute a newsletter subscription. A birth certificate or other proof should not be attached to the initial email.

20.4 Draw, Notification, and Verification

On November 2, 2026, ten families will be drawn randomly from all complete and timely registrations received, using an electronic random selection process. All complete and timely registrations have an equal chance of winning. The draw initially establishes a provisional entitlement to win.

The drawn families will be notified by email. Only from them will the organizer request proof of eligibility. A copy or photo of the birth certificate, showing the child's first name, date of birth, and place of birth Bocholt, is sufficient as proof. Unnecessary information, in particular parents' data, registration numbers, and other details, may be blacked out.

The requested proof must be submitted completely within 7 calendar days of the request. If a drawn family cannot prove the requirements in due time or sufficiently, or if a statement turns out to be inaccurate, the provisional entitlement to win will lapse. In this case, another family will be drawn randomly from the remaining complete and timely registrations.

20.5 Promotional Gift and Shipping

Ten successfully verified families will each receive a personalized wooden tricycle from Schmatzepuffer. The personalization will feature the first name of the eligible child provided during registration. Cash payment, exchange, or transfer of the promotional gift is excluded.

Shipping to the delivery address in North Rhine-Westphalia communicated after successful verification is free of charge.

20.6 Data Protection and Press Photos

The proof submitted for verification will be used exclusively for the verification of this promotion and deleted immediately after verification is complete. Data required for shipping and processing will otherwise be processed in accordance with the privacy policy and statutory retention obligations. Hospitals, midwives, or other third parties are not involved in the promotion and do not transmit any data to the organizer.

Participation, prize handover, and shipping of the wooden tricycle are not tied to any press, photo, or video publication. Such publication will only take place with the prior, separate consent of the person concerned.

20.7 Priority of these Special Conditions

For the "Bocholt September Babies - Wooden Tricycle Raffle 2026," these special terms and conditions shall take precedence over the general terms and conditions in case of contradictions.
